for the purpose of obtaining value to which the User knows or reasonably should know the User is not entitled.

Discovery of a technical or financial error does not transfer ownership of erroneous value to the User.

Compliance With Applicable Law

Legal Compliance

A User shall comply with all laws and regulations applicable to the User’s activities through Sizzle Social.

Prohibited activity includes using Sizzle Social to commit, facilitate, assist, solicit, conceal or materially support conduct that is unlawful under applicable law.

Sizzle Social is not required to continue providing a Service where doing so would itself be unlawful.

Conflicting Legal Requirements

Where a User’s requested activity becomes unlawful because of a regulatory order, court order, sanctions restriction, statutory prohibition or other binding legal requirement, Sizzle Social may restrict or discontinue the affected activity.

Any resulting billing or refund issue shall be addressed under the applicable payment and refund policies.

Compliance With Third-Party Platform Rules

Independent Social Platforms

Sizzle Social provides Services relating to independent social media, content, music and other digital platforms.

Those platforms maintain their own:

  • terms of service;

  • community standards;

  • advertising policies;

  • content rules;

  • account requirements;

  • technical restrictions; and

  • enforcement procedures.

A User remains responsible for determining whether the User’s intended use of a Sizzle Social Service complies with the rules applicable to the relevant third-party account, content or platform.

No Representation of Third-Party Approval

Availability of a Service through Sizzle Social shall not constitute a representation that the underlying third-party platform:

  • approves the Service;

  • endorses Sizzle Social;

  • guarantees continued account access;

  • will not change its rules;

  • will not modify algorithms; or

  • will not take enforcement action.

Sizzle Social shall not be treated as having authority to waive an independent platform’s rules.

Fraud Is Prohibited

Sizzle Social shall not be used in connection with fraudulent, dishonest or knowingly deceptive conduct.

Prohibited conduct includes:

  • knowingly providing false material information to obtain Services or financial value;

  • creating false evidence of payment;

  • falsifying refund evidence;

  • creating fraudulent chargebacks;

  • impersonating another person for financial gain;

  • manipulating Platform records;

  • intentionally concealing material facts during an investigation; or

  • using Sizzle Social as part of a fraudulent scheme.

False Documents and Evidence

A User shall not provide Sizzle Social with materially false, altered or fabricated:

  • payment receipts;

  • bank-transfer screenshots;

  • identification documents;

  • transaction confirmations;

  • support screenshots;

  • Order evidence;

  • ownership records;

  • complaint evidence;

  • refund evidence; or

  • other documents submitted for verification.

An innocent factual mistake shall not be treated as fraud merely because information later proves inaccurate.

Fraud requires consideration of the circumstances and available evidence.

Identity and Impersonation

Unauthorised Impersonation

A User shall not use Sizzle Social to falsely represent that the User is another identifiable person, organisation or authority where the representation is intended to deceive, defraud, obtain unauthorised access or otherwise cause unlawful harm.

Prohibited impersonation may include falsely representing oneself as:

  • another customer;

  • a Sizzle Social employee;

  • a payment provider;

  • a government official;

  • a business;

  • a celebrity;

  • an account owner;

  • an authorised representative; or

  • another person whose identity the User has no authority to assume.

Permitted Agency and Representative Use

This provision does not prohibit legitimate activity undertaken by an authorised:

  • agency;

  • employee;

  • social media manager;

  • reseller;

  • representative;

  • contractor; or

  • business administrator.

Where authority is disputed, Sizzle Social may request reasonable evidence of authorisation.

Account Integrity

Accurate Account Information

Material Account information supplied to Sizzle Social shall be accurate to the extent reasonably required to administer the Account and provide Services.

A User shall not intentionally create materially false Account information for the purpose of:

  • obtaining another person’s Account;

  • evading enforcement;

  • abusing promotions;

  • conducting fraud;

  • avoiding payment obligations; or

  • defeating security controls.

Unauthorised Account Access

A User shall not:

  • access another User’s Sizzle Social Account without authority;

  • obtain another User’s password through deception;

  • use stolen credentials;

  • defeat authentication controls;

  • intercept another User’s session;

  • exploit Account-recovery procedures;

  • purchase unauthorised access to a Sizzle Social Account; or

  • facilitate any such activity.

Multiple Accounts

Maintaining more than one Account shall not be prohibited merely because multiple Accounts exist unless a specific Platform rule states otherwise.

Multiple Accounts shall, however, not be used to:

  • circumvent suspension or termination;

  • repeatedly obtain one-time promotional benefits;

  • evade transaction limits;

  • manipulate referrals;

  • conceal fraudulent activity;

  • avoid negative balances;

  • bypass security controls; or

  • otherwise defeat Platform restrictions.

Account Security

User Security Obligations

Users shall take reasonable steps to protect credentials and access mechanisms associated with Sizzle Social.

Credentials shall not knowingly be disclosed to an unauthorised person where such disclosure creates a security risk.

Compromised Accounts

Where Sizzle Social reasonably suspects that an Account has been compromised, Sizzle Social may:

  • require password reset;

  • require additional authentication;

  • temporarily restrict Wallet activity;

  • suspend API credentials;

  • pause sensitive Account changes;

  • restrict refunds; or

  • take another proportionate security measure.

Such restrictions shall be applied for protective purposes and shall not constitute automatic forfeiture of legitimate Customer-Funded Balance.

Unauthorised Access Is Prohibited

No person may attempt to gain unauthorised access to:

  • Sizzle Social servers;

  • databases;

  • administrative systems;

  • hosting environments;

  • defeat bot controls;

  • evade anti-fraud systems;

  • disable security mechanisms;

  • exploit broken access controls;

  • reuse revoked credentials;

  • bypass API restrictions; or

  • use another method intended to obtain access beyond that authorised.

Vulnerability Exploitation

A person who discovers a suspected security vulnerability shall not exploit the vulnerability beyond what is reasonably necessary to identify and responsibly report it.

A person shall not use a vulnerability to:

  • access another User’s information;

  • extract data;

  • modify records;

  • obtain financial value;

  • escalate privileges unnecessarily;

  • disrupt the Platform;

  • plant malware;

  • obtain credentials; or

  • create persistence within Sizzle Social systems.

Nothing in this Policy shall be interpreted as authorising security testing for which Sizzle Social has not granted permission.

Where Sizzle Social publishes a separate Responsible Disclosure or Security Policy, that policy shall govern authorised vulnerability reporting.

Malware and Malicious Code

Malicious Software Is Prohibited

Sizzle Social shall not be used to upload, distribute, introduce, transmit or facilitate:

  • malware;

  • ransomware;

  • spyware;

  • credential stealers;

  • viruses;

  • worms;

  • trojans;

  • malicious scripts;

  • destructive code;

  • botnet software;

  • unauthorised cryptomining software; or

  • other code primarily designed to compromise, damage or unlawfully access systems.

Malicious Files and Links

Files, URLs, attachments and other Content submitted through support, complaints or other Platform functions shall not intentionally contain malicious payloads or deceptive links designed to compromise Sizzle Social personnel, Users or service providers.

Phishing and Credential Theft

Credential Harvesting Is Prohibited

A User shall not use Sizzle Social, its Services or information obtained through the Platform to create, distribute or facilitate phishing or credential-harvesting activity.

This prohibition includes attempts to obtain another person’s:

  • password;

  • OTP;

  • card PIN;

  • online-banking credentials;

  • API key;

  • authentication token;

  • recovery code;

  • private cryptographic key;

  • seed phrase; or

  • other authentication secret

through deception or unauthorised means.

Interference With Platform Operations

System Disruption

A User shall not intentionally interfere with or materially degrade the normal operation of Sizzle Social.

Prohibited activity includes:

  • denial-of-service attacks;

  • distributed denial-of-service attacks;

  • request flooding;

  • resource exhaustion;

  • deliberate database overload;

  • automated request storms;

  • malicious traffic generation;

  • deliberate disruption of supplier connections;

  • interference with payment callbacks;

  • interference with webhooks;

  • interference with scheduled processing; or

  • another deliberate attempt to impair availability.

Abuse of Technical Errors

A User shall not intentionally repeat actions known to trigger a technical defect for the purpose of:

  • duplicating value;

  • duplicating Orders;

  • obtaining multiple refunds;

  • avoiding payment;

  • corrupting records;

  • bypassing limits; or

  • causing system disruption.

Automated Access

Unauthorised Automation

Automated Access to Sizzle Social is prohibited unless:

  • the functionality is expressly provided by Sizzle Social;

  • access occurs through an authorised API;

  • Sizzle Social has otherwise authorised the activity; or

  • applicable law establishes a right that cannot lawfully be restricted.

Prohibited Automated Activity

Without appropriate authorisation, a User shall not employ bots, crawlers, scripts, headless browsers, scrapers or similar systems to:

  • mass-create Accounts;

  • copy the Service catalogue;

  • extract pricing systematically;

  • scrape customer information;

  • collect supplier information;

  • bypass API requirements;

  • place excessive Orders;

  • overwhelm infrastructure;

  • defeat anti-abuse controls;

  • harvest Content;

  • test stolen credentials; or

  • perform another activity outside the intended Platform interface.

Legitimate browser functionality, accessibility technology and ordinary search-engine indexing authorised by Sizzle Social shall not be treated as prohibited automation merely because software is involved.

Scraping and Data Extraction

Unauthorized Extraction

No person may systematically extract, reproduce or compile substantial information from Sizzle Social through unauthorised technical means.

This includes unauthorised collection of:

  • Service catalogues;

  • pricing databases;

  • customer information;

  • provider information;

  • internal identifiers;

  • API responses;

  • documentation;

  • proprietary Content; or

  • other protected Platform data.

Permitted Use of User Data

This provision shall not prevent a User from downloading or accessing information that Sizzle Social expressly makes available for that User’s own legitimate use, including applicable personal-data access rights.

API Use

Authorised API Access

API functionality shall be accessed only using credentials properly issued or authorised for the relevant Account.

An API credential remains subject to:

  • applicable authentication rules;

  • rate limits;

  • Service limits;

  • security controls;

  • pricing;

  • Order requirements;

  • the Terms of Service;

  • this Policy; and

  • the API & Reseller Terms.

API Credential Security

API credentials shall be treated as confidential.

A User shall not intentionally:

  • publish an active private API key;

  • expose credentials in public repositories;

  • sell unauthorised API access;

  • use another User’s key;

  • obtain keys through credential theft; or

  • bypass credential revocation.

API Abuse

API users shall not:

  • exceed technical limits through deliberate circumvention;

  • rotate Accounts or IP addresses primarily to defeat rate limits;

  • send malformed requests intended to compromise infrastructure;

  • intentionally generate excessive failed requests;

  • probe undocumented endpoints without authorisation;

  • exploit discrepancies between API and website pricing;

  • replay requests to create duplicate financial value;

  • manipulate callback or status information;

  • falsify end-customer information for fraudulent purposes; or

  • use the API as part of an unlawful service.

API Availability and Enforcement

Where an API credential presents a material security, fraud or operational risk, Sizzle Social may temporarily restrict or revoke that credential.

Restriction of an API credential shall not necessarily require termination of the associated User Account where a narrower measure adequately addresses the risk.

Reseller and Agency Conduct

Independent Customer Relationships

A reseller, agency, freelancer or intermediary using Sizzle Social remains responsible for the representations made to its own customers.

Such Users shall not knowingly misrepresent:

  • delivery guarantees;

  • refill guarantees;

  • service characteristics;

  • Sizzle Social affiliation;

  • third-party platform endorsement;

  • refund rights;

  • pricing;

  • Service source; or

  • commercial results

in a manner that is fraudulent or unlawful.

No False Representation of Official Status

Unless expressly authorised, a reseller shall not represent itself as:

  • Sizzle Social;

  • Sizzle Digital Technologies;

  • an official branch of Sizzle Social;

  • an employee of Sizzle Social; or

  • a person authorised to bind Sizzle Social contractually.

Permitted resale of Services does not, by itself, create an agency, franchise, partnership or employment relationship.

Downstream Abuse

A reseller shall not knowingly use Sizzle Social to fulfil downstream transactions that the reseller knows are fraudulent, unlawful or otherwise prohibited by this Policy.

Where Sizzle Social reasonably identifies systematic abuse associated with a reseller’s downstream activity, appropriate restrictions may be imposed.

Payment Abuse

Authorized Payment Methods Only

Users shall fund Accounts only through payment instruments they are lawfully entitled to use.

Prohibited conduct includes:

  • stolen-card use;

  • unauthorised bank-account use;

  • compromised payment credentials;

  • false transfer evidence;

  • fabricated receipts;

  • fraudulent virtual-account transactions;

  • unauthorised cryptocurrency transactions; or

  • other payment fraud.

Payment Reconciliation Abuse

A User shall not intentionally claim that a Payment is missing where the User knows that:

  • the Payment failed;

  • the Payment was reversed;

  • the Payment was refunded;

  • the Payment was never sent; or

  • Sizzle Social has already provided the corresponding Wallet value.

Erroneous Wallet Credits

A User who becomes aware that the Wallet contains an obvious erroneous or duplicate credit shall not deliberately exploit the error.

Sizzle Social may correct erroneous Wallet entries in accordance with the Billing, Wallet & Payment Policy.

Chargeback Abuse

Genuine Disputes Remain Permitted

Nothing in this Policy prohibits a legitimate chargeback, bank dispute or payment complaint concerning:

  • an unauthorised Payment;

  • a duplicate Payment;

  • a fraudulent transaction;

  • a materially unresolved payment issue; or

  • another legitimately disputed transaction.

Fraudulent Chargebacks Are Prohibited

Prohibited chargeback conduct includes knowingly:

  • disputing an authorised Payment after receiving the purchased Service;

  • claiming that a legitimate Payment was fraudulent;

  • seeking a chargeback after already receiving a full refund;

  • recovering the same value through multiple channels;

  • submitting false evidence to a bank or Payment Provider; or

  • repeatedly using chargebacks to avoid legitimate payment obligations.

The existence of a chargeback shall not, by itself, establish abuse.

The surrounding evidence and resolution of the dispute shall be considered.

Refund Abuse

Good-Faith Refund Requests

A User may exercise legitimate refund rights without being penalised merely for requesting redress.

A refund request shall not be treated as abuse solely because the User:

  • alleges non-delivery;

  • disputes performance;

  • requests an external refund;

  • rejects a proposed resolution;

  • escalates a complaint; or

  • exercises an applicable consumer right.

Fraudulent or Duplicative Refund Claims

Refund abuse may include knowingly:

  • claiming non-delivery after valid delivery;

  • using fabricated evidence;

  • requesting reimbursement for value already refunded;

  • spending Wallet value and seeking an external refund of the same value;

  • obtaining both a chargeback and a duplicate refund;

  • manipulating Orders to generate refund credits;

  • using multiple Accounts to submit duplicate claims; or

  • misrepresenting the source of Promotional Credit as Customer-Funded Balance.

Refund disputes shall otherwise be determined under the Refund Policy.

Coupons, Rewards and Promotional Abuse

Promotional Conditions

Coupons, rewards, referral incentives, tier benefits and other promotional programmes may be subject to eligibility and usage conditions.

A User shall not manipulate such programmes through:

  • duplicate Accounts;

  • fictitious referrals;

  • self-referrals where prohibited;

  • false identities;

  • automated Account creation;

  • coordinated abuse;

  • transaction reversal after obtaining a benefit;

  • coupon stacking contrary to disclosed conditions; or

  • another method intended to obtain benefits outside the applicable promotion rules.

Correction of Abusive Promotional Credits

Where promotional value is obtained through material abuse, Sizzle Social may reverse or withdraw the improperly obtained promotional value.

Such reversal shall not authorise confiscation of unrelated legitimate Customer-Funded Balance.

Order Manipulation

Intentional Manipulation of Order Systems

A User shall not intentionally manipulate Order functionality to obtain Services or financial value outside the intended transaction.

Prohibited conduct may include:

  • exploiting duplicate Order submission;

  • intentionally reproducing requests known to generate duplicate delivery;

  • manipulating Service IDs;

  • tampering with request parameters;

  • exploiting pricing mismatches;

  • intentionally submitting malformed API requests to obtain an incorrect price;

  • altering client-side values to evade payment; or

  • knowingly exploiting an Order-status defect.

Overlapping Orders

Placing overlapping Orders is not necessarily prohibited in every circumstance.

However, a User shall not knowingly create overlapping Orders for the purpose of:

  • manufacturing a false non-delivery claim;

  • obscuring delivery attribution;

  • obtaining duplicate refills;

  • obtaining duplicate refunds; or

  • misleading Sizzle Social during an investigation.

Ordinary overlapping Orders remain subject to the Service Delivery provisions of the Terms of Service.

Abuse of Refill Systems

False Refill Claims

Where a Service includes refill support, a User shall not knowingly submit materially false information concerning:

  • original quantity;

  • current quantity;

  • delivery status;

  • username history;

  • overlapping Orders; or

  • another matter relevant to refill eligibility.

Digital Accounts and Digital Products obtained through Sizzle Social shall not be used for unlawful conduct.

A User shall not knowingly use such products to:

  • defraud another person;

  • conduct phishing;

  • impersonate another person unlawfully;

  • obtain unauthorised access;

  • distribute unlawful material;

  • evade a lawful restriction through fraudulent means; or

  • facilitate another prohibited activity.

Credential Handling

Where a Digital Product includes credentials, Users shall comply with applicable product instructions concerning credential changes, transfer and support.

A User shall not use a Digital Product as a basis for attacking, probing or compromising Sizzle Social or an upstream supplier.

Detailed rules governing Digital Products are contained in the Digital Accounts & Digital Products Policy.

This is particularly relevant to:

  • support tickets;

  • refund requests;

  • complaints;

  • attachments;

  • customer information;

  • API transactions; and

  • reseller activity.

A User shall avoid submitting unrelated personal information where it is unnecessary for the relevant request.

Intellectual Property

Infringing Use Is Prohibited

A User shall not submit or distribute Content through Sizzle Social where the User knows that doing so unlawfully infringes another person’s protected rights.

  • otherwise exploit Sizzle Social intellectual property contrary to applicable law.

Detailed intellectual-property provisions are contained in the Intellectual Property & Copyright Policy.

Deceptive Websites and Brand Impersonation

Prohibited activity includes:

  • fake Sizzle Social login pages;

  • fake payment pages;

  • fraudulent customer-support Accounts;

  • fake refund pages;

  • impersonating staff;

  • another form of harassment prohibited by applicable law.

Conduct Towards Sizzle Social Personnel

Customers may criticise Sizzle Social, dispute decisions, make complaints, demand redress and communicate dissatisfaction.

Such conduct shall not be treated as prohibited merely because it is critical.

However, serious misconduct directed toward Sizzle Social personnel may result in proportionate communication or Account restrictions.

Such misconduct may include:

  • credible threats;

  • repeated targeted harassment;

  • publication of private employee information for malicious purposes;

  • attempts to compromise staff Accounts;

  • extortion; or

  • conduct creating a genuine safety or security concern.

Enforcement shall distinguish between legitimate customer dissatisfaction and actual abuse.

Hate, Violence and Incitement

Unlawful Incitement and Threatening Conduct

Sizzle Social shall not be used to facilitate content or activity that constitutes unlawful incitement to violence, credible threats or another prohibited form of violent conduct.

This Policy shall not be applied merely to suppress lawful criticism, disagreement, satire, political expression or controversial opinion.

Restrictions shall be based on applicable law, relevant third-party platform requirements or another legitimate safety basis.

Child Sexual Exploitation and Abuse

Zero Tolerance for Child Sexual Abuse Material

Sizzle Social shall not be used in any manner to create, obtain, distribute, promote, sell, transmit or facilitate child sexual abuse material or the sexual exploitation of a child.

  • financial services;

  • gambling;

  • pharmaceuticals;

  • controlled substances;

  • weapons;

  • age-restricted products;

  • investment products; or

  • other regulated goods and services.

The inclusion of a category in this section does not mean every lawful activity within that category is automatically prohibited.

The determining factor is whether the specific use is lawful and otherwise complies with this Policy.

Fraudulent Commercial Activity

Sizzle Social shall not be used to facilitate knowingly false commercial representations intended to defraud customers or other persons.

This includes schemes involving:

  • fake businesses;

  • advance-fee fraud;

This provision shall not make Sizzle Social the general arbiter of every commercial disagreement between third parties.

False Reviews and Deceptive Testimonials

No Fraudulent Review Schemes

Ordinary social engagement Services shall not automatically constitute a review or testimonial.

The relevant purpose and representation shall determine whether this provision applies.

Platform Manipulation Affecting Legal or Financial Rights

Prohibited Manipulation

Sizzle Social shall not knowingly be used for schemes intended to manipulate systems where the activity would constitute fraud, unlawful market manipulation or another offence.

This may include attempts to manipulate:

  • regulated financial markets;

  • voting systems;

  • financial eligibility;

  • regulated contests;

  • legally significant rankings; or

  • other systems where false activity is used as part of unlawful conduct.

The use of ordinary promotional Services for lawful visibility or social proof does not, by itself, fall within this prohibition.

Interference With Investigations

Evidence Preservation

Once a User has been informed that a transaction, Account or activity is under a legitimate fraud, security, payment or legal investigation, the User shall not intentionally tamper with Sizzle Social records or systems to conceal material evidence.

This does not prohibit a User from:

  • closing a third-party social media Account;

An honest disagreement concerning facts shall not constitute falsification.

Users may submit support requests, complaints and follow-ups concerning genuine issues.

High complaint frequency alone shall not constitute abuse where the underlying issues are legitimate.

Prohibited Support Abuse

A User shall not intentionally use support systems to:

  • distribute malware;

  • threaten staff;

  • submit automated ticket floods;

  • repeatedly submit identical tickets primarily to impair support operations;

  • impersonate another User;

  • fabricate evidence;

  • harvest staff information; or

  • conduct another prohibited activity.

Sizzle Social should, where reasonably possible, address repetitive but genuine complaints through consolidation rather than punitive enforcement.

Reporting Violations

Reports to Sizzle Social

Suspected violations of this Policy may be reported through official Sizzle Social support or complaint channels.

A report should contain sufficient information to enable reasonable review.

Where applicable, useful information may include:

  • Account identifier;

  • Order reference;

  • relevant URL;

  • date and time;

  • description of the suspected violation;

  • screenshots or other supporting evidence; and

  • information explaining the reporter’s connection to the matter.

A reporter should not obtain evidence through unlawful access merely for the purpose of making a report.

False or Malicious Reports

A person shall not knowingly submit fabricated allegations for the purpose of:

  • disabling another User’s Account;

  • interfering with a competitor;

  • obtaining an improper refund;

  • harassing another person; or

  • manipulating Sizzle Social enforcement.

A report shall not be considered malicious merely because an investigation ultimately determines that no violation occurred.

Investigation of Suspected Violations

Reasonable Review

Sizzle Social may investigate suspected violations using information reasonably available to it.

An investigation may consider:

  • Account activity;

  • transaction history;

  • Wallet records;

  • API logs;

  • Order information;

  • support correspondence;

  • technical logs;

  • payment records;

  • supplier information;

  • security signals;

  • submitted evidence; and

  • other relevant information lawfully available.

No Requirement to Disclose Sensitive Detection Methods

Sizzle Social shall not be required to disclose security controls, anti-fraud models, confidential supplier information or investigative methods where disclosure would:

  • compromise security;

  • facilitate circumvention;

  • prejudice an investigation;

  • expose another person’s personal data;

  • reveal protected confidential information; or

  • otherwise create an unreasonable risk.

This provision shall not prevent disclosure required by law, regulation, court order or applicable consumer rights.

Interim Protective Measures

Temporary Restrictions

Where Sizzle Social reasonably identifies an immediate or material risk involving fraud, security, unlawful activity, payment abuse or harm to Platform integrity, temporary protective restrictions may be applied before a final investigation is completed.

Measures may include:

  • temporary Account restriction;

  • Wallet hold;

  • payment restriction;

  • API-key suspension;

  • Order pause;

  • login reset;

  • access limitation;

  • refund hold;

  • communication restriction; or

  • preservation of relevant records.

Any interim measure shall be proportionate to the identified risk.

No Automatic Finding of Wrongdoing

A temporary restriction does not necessarily constitute a final determination that the User violated this Policy.

Where practicable, the matter shall be reviewed before permanent enforcement is imposed.

Enforcement Measures

Available Enforcement Actions

Where a material violation is established or reasonably requires action, Sizzle Social may apply one or more proportionate measures.

Such measures may include:

  • warning;

  • request to stop specified conduct;

  • removal or rejection of prohibited Content;

  • cancellation of an unlawful or abusive Order;

  • reversal of improperly obtained Promotional Credit;

  • restriction of a feature;

  • payment-method restriction;

  • API restriction;

  • API credential revocation;

  • temporary Account suspension;

  • permanent Account termination;

  • blocking of malicious traffic;

  • preservation of evidence;

  • referral to an affected Payment Provider;

  • referral to an appropriate third-party platform;

  • regulatory reporting;

  • law-enforcement reporting; or

  • legal action.

The appropriate measure shall depend upon the nature, seriousness, frequency and risk of the violation.

Proportionality

Where a narrower measure reasonably addresses the violation, Sizzle Social may use that measure instead of full Account termination.

Relevant considerations may include:

  • severity;

  • intent;

  • repeated conduct;

  • financial harm;

  • security risk;

  • effect on other Users;

  • cooperation;

  • prior warnings;

  • likelihood of recurrence; and

  • applicable legal obligations.

Nothing in this section requires Sizzle Social to issue a warning before taking urgent action against serious fraud, security compromise or unlawful conduct.

Immediate Suspension or Termination

Serious Violations

Immediate suspension or termination may be appropriate where Sizzle Social reasonably determines that continued access creates a material risk involving:

  • payment fraud;

  • credential theft;

  • malware;

  • unauthorised system access;

  • deliberate security exploitation;

  • child sexual exploitation;

  • credible threats;

  • serious unlawful conduct;

  • repeated chargeback fraud;

  • substantial API abuse;

  • deliberate evasion of prior enforcement; or

  • another comparably serious violation.

A serious security or legal threat need not remain active merely to provide advance notice.

Wallet Balances After Enforcement

No Automatic Forfeiture of Genuine Customer Funds

Suspension or termination for violation of this Policy shall not, by itself, authorize Sizzle Social to confiscate legitimate unused Customer-Funded Balance as a penalty.

Following enforcement, Sizzle Social may reconcile:

  • active Orders;

  • valid debts;

  • negative Wallet balances;

  • chargebacks;

  • fraudulent Payments;

  • erroneous credits;

  • applicable refunds;

  • promotional balances;

  • disputed transactions; and

  • lawful holds.

Any remaining eligible Customer-Funded Balance shall be handled in accordance with the Billing, Wallet & Payment Policy and Refund Policy.

Promotional Credit

Promotional Credit may be revoked upon Account termination where the applicable promotional terms permit such revocation, particularly where the credit was obtained or used through abuse.

Promotional Credit shall remain distinct from genuine Customer-Funded Balance.

Existing Orders After Enforcement

Order Review

Where an Account is suspended or terminated while Orders remain active, Sizzle Social may determine whether each affected

Order should:

  • continue;

  • be paused;

  • be cancelled;

  • be refunded;

  • be partially refunded; or

  • be otherwise resolved.

The outcome shall depend upon:

  • Service status;

  • extent of performance;

  • reason for enforcement;

  • legal restrictions;

  • third-party supplier status; and

  • applicable refund rights.

Account enforcement shall not automatically eliminate remedies applicable to an unrelated failed Service.

Evasion of Enforcement

Circumvention Is Prohibited

A person whose access has been restricted shall not intentionally evade the restriction through:

  • new Accounts;

  • false identities;

  • another person’s Account;

  • rotated API keys;

  • proxy infrastructure;

  • alternative email addresses;

  • manipulated device information; or

  • another method

where the primary purpose is to defeat a valid Sizzle Social enforcement action.

This provision shall not prevent a person from submitting an appeal or complaint concerning the restriction.

Appeals and Complaints

Review of Enforcement Decisions

Where a User believes that an enforcement decision was incorrect, disproportionate or based on materially inaccurate information, the User may seek review through the applicable Sizzle Social complaint process.

A review request should identify, where available:

  • affected Account;

  • relevant enforcement decision;

  • reason for disagreement;

  • supporting evidence; and

  • any material information not considered previously.

Complaints Procedure

Formal complaints concerning enforcement may be submitted under the Complaints & Dispute Resolution Policy.

Use of an internal complaint process shall not remove a statutory right to approach a competent regulator or court where such right exists.

Cooperation With Payment Providers and Third Parties

Fraud and Security Cooperation

Where reasonably necessary and lawful, Sizzle Social may cooperate with:

  • banks;

  • Payment Providers;

  • hosting providers;

  • social media platforms;

  • cybersecurity providers;

  • service suppliers;

  • professional advisers;

  • regulators; or

  • law-enforcement authorities

in connection with fraud, security incidents, payment disputes, unlawful activity or enforcement of legal rights.

Any disclosure of personal data shall remain subject to applicable privacy and data-protection requirements.

Regulatory and Law-Enforcement Requests

Lawful Requests

Sizzle Social may preserve or disclose information where required by:

  • applicable law;

  • valid court order;

  • lawful warrant;

  • regulatory requirement;

  • legally binding government request; or

  • another compulsory legal process.

Sizzle Social may assess the validity and scope of a request before responding where legally permitted.

No Voluntary Unlimited Access

This provision shall not be interpreted as granting unrestricted access to User information to any person or authority merely because information has been requested.

Disclosure shall remain limited to what is lawfully required or otherwise permitted.

Preservation of Evidence

Legal and Security Holds

Sizzle Social may preserve information beyond its ordinary retention period where reasonably necessary for:

  • fraud investigations;

  • security incidents;

  • payment disputes;

  • chargebacks;

  • litigation;

  • regulatory inquiries;

  • law-enforcement requests;

  • enforcement of contractual rights; or

  • defence of legal claims.

A preservation hold shall not authorise unrelated use of retained information.

Privacy During Enforcement

Processing of Enforcement Data

Personal data processed in connection with investigations and enforcement shall remain subject to the Privacy Policy.

Relevant information may include:

  • Account data;

  • technical logs;

  • IP information;

  • transaction records;

  • API records;

  • support communications;

  • fraud indicators;

  • security events; and

  • evidence submitted by affected persons.

Only information reasonably relevant to legitimate investigation, security, compliance or legal purposes should be processed.

No General Monitoring Obligation

Enforcement Does Not Require Universal Surveillance

Nothing in this Policy shall require Sizzle Social to continuously monitor every:

  • User;

  • Order;

  • social media destination;

  • reseller customer;

  • external website;

  • API transaction; or

  • third-party platform activity

unless applicable law imposes a specific monitoring obligation.

Sizzle Social may nevertheless use reasonable technical and manual measures to identify fraud, abuse, security threats and Policy violations.

No Guarantee of Detection

Undetected Abuse

The fact that prohibited conduct has not been immediately identified or prevented shall not constitute approval of that conduct.

Failure to enforce a particular violation immediately shall not constitute a permanent waiver of the applicable Policy provision.

User Responsibility for Third-Party Activity

Activity Under the Account

A User may be responsible for activity carried out through the User’s Account, API credentials or authorised integrations where the activity was authorised by the User or resulted from the User’s failure to take reasonable security precautions.

The User shall not automatically be held responsible for unauthorised activity merely because the activity originated through the User’s Account.

The circumstances of any compromise shall be investigated where material.

Employees and Contractors

A business Account holder shall take reasonable measures to ensure that employees, contractors and other authorised persons using the Account comply with this Policy.

Where an authorised person violates this Policy while acting through the business Account, Sizzle Social may take proportionate action affecting the Account.

No Creation of Third-Party Rights

Contractual Nature of This Policy

This Policy principally governs the relationship between Sizzle Social and its Users.

Nothing in this Policy shall automatically create a contractual right in favour of an unrelated third party unless applicable law provides otherwise.

This provision shall not affect independent legal rights held by third parties under applicable law.

Consumer Rights

Acceptable Use Enforcement and Consumer Protection

Enforcement of this Policy shall not be used to remove a consumer right that cannot lawfully be excluded.

A User’s violation of this Policy may affect an entitlement where the violation caused or materially contributed to the relevant loss or Service failure.

However, Sizzle Social shall not rely upon an unrelated minor violation as a basis for avoiding a refund or remedy otherwise required by law.

Fair and Transparent Enforcement

Where reasonably possible, enforcement decisions affecting ordinary consumer use should be based upon understandable rules and material evidence.

Nothing in this section shall require disclosure of confidential security mechanisms or prevent urgent protective action.

Relationship With the Terms of Service

General Contractual Rules

The Terms of Service establish the general contractual relationship governing access to and use of Sizzle Social.

This Policy establishes the more specific rules governing acceptable and prohibited conduct.

Where the Terms contain a general prohibition and this Policy contains a more specific conduct rule, both shall be interpreted together.

Relationship With the Billing, Wallet & Payment Policy

Financial Abuse

Payment fraud, chargebacks, Wallet manipulation, erroneous credits and related financial matters are governed by this Policy together with the Billing, Wallet & Payment Policy.

Where enforcement gives rise to a refund issue, the Refund Policy shall determine refund eligibility.

Relationship With the API & Reseller Terms

Specialist API Rules

API and reseller activity remains subject to this Policy.

The API & Reseller Terms may impose additional technical, commercial, security and downstream-customer obligations.

A breach of those specialist terms may also constitute a breach of this Policy where the conduct falls within a prohibited-use category.

Relationship With the Digital Accounts Policy

Digital Product Conduct

Digital Accounts and Digital Products remain subject to this Policy and the Digital Accounts & Digital Products Policy.

Where a Digital Product is used for prohibited unlawful conduct, Sizzle Social may apply appropriate enforcement independently from any warranty or support issue affecting the product.

Relationship With Intellectual Property Rules

Copyright and Trademark Matters

Intellectual-property complaints and takedown procedures shall be governed principally by the Intellectual Property & Copyright Policy.

This Policy establishes the general prohibition against knowingly using Sizzle Social for unlawful infringement.

Relationship With Privacy Rights

Data Protection Remains Applicable

Security, fraud and enforcement activity under this Policy shall remain subject to applicable privacy law.

Enforcement shall not be used as a pretext to:

  • defeat a legitimate access request;

  • prevent lawful correction of personal data;

  • unlawfully retain information indefinitely;

  • suppress a privacy complaint; or

  • retaliate against a Data Subject for exercising a statutory right.

Privacy rights may nevertheless be subject to lawful restrictions where information is required for fraud prevention, legal claims, security or another applicable legal basis.

Changes to This Policy

Policy Amendments

Sizzle Social may amend this Policy to reflect:

  • changes in applicable law;

  • cybersecurity developments;

  • fraud patterns;

  • new Platform functionality;

  • new APIs;

  • new Digital Products;

  • payment-system changes;

  • changes to reseller functionality;

  • regulatory requirements; or

  • improvements to Platform protection.

The Last Updated date shall identify the current published version.

Material Changes

Where a material change significantly alters User obligations and notice is legally required or reasonably appropriate, Sizzle Social may provide notice through:

  • the Platform;

  • User dashboard;

  • email;

  • published legal notice; or

  • another appropriate method.

A later Policy amendment shall not be used to retrospectively characterise previously permitted conduct as a contractual violation where doing so would be unfair or unlawful.

Mandatory Law

Applicable Law Prevails

Where a provision of this Policy conflicts with a mandatory requirement of applicable law, the mandatory legal requirement shall prevail to the extent of the conflict.

Nothing in this Policy authorises:

  • unlawful surveillance;

  • unlawful confiscation of customer funds;

  • restriction of statutory consumer rights;

  • unlawful disclosure of personal data;

  • retaliation for regulatory complaints; or

  • another action prohibited by law.

Severability

Effect of Invalid Provisions

If any provision of this Policy is determined by a competent authority to be unlawful, invalid or unenforceable, the remaining provisions shall continue in effect to the fullest extent permitted by law.

The affected provision shall be interpreted or modified only to the minimum extent required to make it lawful while preserving its legitimate purpose.

No Waiver

Failure to Enforce

Failure by Sizzle Social to enforce a provision immediately shall not constitute a permanent waiver of that provision.

Granting an exception in one case shall not create an automatic entitlement to the same exception in another case.

Governing Law

Nigerian Law

This Policy shall be governed principally by the laws of the Federal Republic of Nigeria, without prejudice to any mandatory right or obligation arising under another applicable jurisdiction.

Final Legal Effect

Preservation of Legitimate Use and Legal Rights

This Policy is intended to protect the integrity, lawful operation and security of Sizzle Social while permitting legitimate use of the Platform and its Services.

Nothing in this Policy shall be interpreted as:

  • prohibiting ordinary lawful use of Sizzle Social’s social media growth Services merely because the Services involve digital promotion;

  • authorising arbitrary Account termination;

  • allowing Sizzle Social to confiscate genuine Customer-Funded Balance as a punishment;

  • preventing legitimate complaints;

  • preventing legitimate refund requests;

  • prohibiting genuine chargebacks;

  • preventing a User from criticising Sizzle Social;

  • requiring waiver of statutory consumer rights;

  • requiring waiver of privacy rights;

  • preventing access to regulators or courts where legally available;

  • authorising disclosure of personal information without lawful basis; or

  • excluding a liability or remedy that applicable law does not permit Sizzle Social to exclude.

The application of this Policy shall depend upon the nature of the conduct, available evidence, applicable law, legitimate security and commercial interests, and the rights of affected Users and third parties.
